The Act requires the nationwide employer to inform applicants in writing that they have not been removed from the file,that the items on their file will remain there until a resolution is found,or that they will be removed within a specified period of time. The Act also requires the nationwide employer to provide applicants with a copy of this letter and their right to dispute the item.

Finally,employers who want to obtain more specific information about a person should consider using social media to conduct a background check.

In order to get the most out of these background investigations,employers should look into whether or not they can get a court order. The Fair Credit Reporting Act gives employers the right to order a person’s background check. However,courts are hesitant to order public records without first finding out if there is good reason to do so.
